General terms and conditions of use
1. Definitions
‘App’ means the application software provided by POST, hosted by SAP in IT centres within the European Union. Candidates can use the App to access the Service by visiting careers.postgroup.lu from the browser on their Device.
‘Candidate’ means any person who expresses an interest in applying for a job with POST and creates a Candidate profile/account in the App.
‘Terms and Conditions of Use’ or ‘TCU’ means these terms and conditions of use relating to the Site Carrière POST Service.
‘POST’ means (i) POST Telecom S.A., registered in the Luxembourg Trade and Companies Register (RCS) under number B43.290, with its registered office at 1, rue Emile Bian, L-1235 Luxembourg, (ii) POST Luxembourg, a public institution registered in the Luxembourg RCS under number J28 and with its registered office at 38, place de la Gare, L-1616 Luxemburg.
‘Site Carrière POST Service(s)’ or ‘Service(s)’ means the service(s) provided by POST through the App as described in article 3 below.
‘Device’ means any device enabling a person to access and use the App and the Services.
2. Scope of application, purpose and amendments to the Terms and Conditions of Use
The Terms and Conditions of Use are applicable to the use of the App and the Service. They apply to all access, consultation and/or use of the Service and/or the App by the Candidate.
The Candidate is deemed to have read these Terms and Conditions of Use and accepted them in full and without reserve when using the service for the first time.
POST reserve the right to amend or update these TCU at any time, within the limits authorised by law. Such amendments shall be deemed binding and in force as soon as they are online and, by using the Service, the Candidate shall be considered to have accepted them. To the extent that the Candidate’s consent is necessary under Luxembourg law, POST will request the Candidate’s agreement under the same conditions as for these TCU.
3. Description of the Service
Subject to technical constraints, the Service enables the Candidate, using the App through their Device, to access the following features (it being understood that these features may be amended or removed and new features may be added):
- creating and managing a personal user account accessed via a customised password;
- managing a Candidate profile with collection of personal data;
- saving documents to compile an application in the Candidate account;
- consulting current job offers;
- applying for current job offers;
- subscribing to receive notifications when new job offers are posted;
- managing interview appointments;
- proposing salary and contractual terms online via the Candidate account.
4. Price and costs linked to using the Service
The App and the Service may be accessed free of charge.
5. Rights, obligations and responsibilities of the Candidate – using the App
The Candidate agrees to use the Service. The Candidate accepts full responsibility for and assumes all risk associated with using the App and the Service, as well as any websites, mobile apps and other content to which they refer. They undertake not to copy, translate, adapt, arrange, amend or distribute the App or Service, in full or in part, in any form whatsoever. They remain fully liable for any fraudulent use and/or misuse thereof by the Candidate or by a third party. They undertake to use the Service in accordance with these Terms and Conditions of Use and all applicable laws and regulations. They are advised to restrict access to their Device by all means at their disposal and not to disclose their password to third parties.
POST cannot be held liable for fraudulent use or misuse of the Service.
The Service is accessible over an internet connection from within Luxembourg, as well as abroad. To use the Service, the Candidate must have an adequate internet connection, for which they remain solely responsible.
6. Rights, obligations and responsibilities of POST
The Service is provided ‘as is’ by POST, which is only bound by a best-endeavours obligation. POST may have cause to interrupt the Service for reasons such as maintenance, security or unlawful or inappropriate content. POST reserves the right, at its sole discretion, to reject a Candidate or prevent them from accessing the Service without warning in the event of non-compliance with the TCU or if POST has legitimate grounds to be concerned about the security of the systems, including the network, or as a result of inappropriate behaviour of any kind from the Candidate. The Candidate is not entitled to any compensation in this regard.
POST can only be held liable in relation to the Service in the event of gross negligence or fraud. Similarly, POST may not under any circumstances be held liable for any indirect harm the Candidate may suffer when using the Service, for any emotional, commercial or financial harm, or for any legal action taken against the Candidate by a third party (this list is not exhaustive).
POST may not under any circumstances be held liable for the reliability of data transmission, access times or any limitations to the Candidate’s access to the internet or networks connected to it. POST is not, under any circumstances, responsible for the deletion, failure to save or store, non-delivery or delayed delivery of information or content.
POST is authorised to withdraw all or part of the Service and block use of the App at any time and without warning.
7. Intellectual property
The App is non-proprietary software used by POST. While it is in use, POST grants the Candidate a temporary, free, non-exclusive and non-transferrable license to access and use the Service.
8. Applicable law and competent jurisdiction
These Terms and Conditions of Use, along with any dispute relating to the Service offered through the App, are strictly governed under Luxembourg law, excluding its conflict-of-laws rules.
The parties shall endeavour to find an amicable solution to any complaints or disputes that may arise between them in relation to the App and the Service offered, its interpretation, its implementation and/or its termination. In this regard, either party may, at any time and without prejudice to any further action, seek mediation from the Centre of Civil and Commercial Mediation (CMCC) in Luxembourg, in accordance with its mediation rules.
The courts of Luxembourg City, in the Grand Duchy of Luxembourg, shall have sole competence to hear any complaints or disputes to which the parties have not been able to find an amicable solution in accordance with the previous articles.
